Legislation - what regulations affect my business?
There are several regulations that govern the protection of private information. These are the drivers for the need for reliable secure document shredding. Probably the most important piece of legislation in the UK is the Data Protection Act(1998). This act stipulates that all information must be kept securely, the details held must be accurate and this private information must not be kept any longer than necessary. Any contravention of the Data Protection Act(1998) by an individual or organisation, is a criminal offence. In the case of public organisations, the Freedom of Information Act(2000) and Freedom of Information (Scotland) Act(2002) govern public access to information held by these organisations. It stipulates that when information is not required to be held and made available under these Acts, then it must be disposed of securely.
There are also other legislative and international standards that apply. The FSA and recent international records management standard ISO 15489, direct all organisations to ensure that secure information disposal is included as part of their records management and included in their business strategy.
